1. Acceptance of Terms

By accessing or using PushNask AI ("Service", "Platform", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users, including visitors, registered users, and paid subscribers.

2. Eligibility

You must be at least 16 years old to use PushNask. By using the Service, you represent and warrant that:

• You are at least 16 years old
• You have the legal capacity to enter into binding contracts
• Your use of the Service does not violate any applicable laws or regulations
• All information you provide is accurate and up-to-date

3. Account Registration & Security

3.1 Account Creation

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your password
• One account per person; no account sharing
• You are responsible for all activities under your account

3.2 Account Security

• Notify us immediately of any unauthorized access: security@pushnask.com
• Use strong, unique passwords (8+ characters recommended)
• We are not liable for losses due to compromised credentials

4. Service Description

PushNask AI provides personalized decision intelligence reports using Multi-Criteria Decision Analysis (MCDA) across four domains:

• Career: AI risk scores and career trajectory analysis
• Travel: Cost-of-living analysis and visa feasibility
• Education: Skill gap mapping and learning path recommendations
• Entrepreneurship: Market vitality and funding ecosystem data

Important: Our reports provide data-driven insights and recommendations. They do not constitute professional career advice, legal advice, immigration consulting, or financial planning. Always consult qualified professionals for specific decisions.

5. Subscription Tiers & P-Token System

5.1 How P-Tokens Work

• P-Tokens (Processing Tokens) are the internal currency used to generate reports
• 1 Executive Report = 5,000 P-Tokens (includes all 4 domains: Career, Travel, Education, Entrepreneurship)
• P-Tokens are deducted only after successful report delivery
• Unused P-Tokens roll over monthly while your subscription is active
• P-Tokens do not expire while your account is active

5.2 Subscription Tiers

Current pricing (subject to change with 30-day notice):

• Student: $5/month — 15,000 P-Tokens (3 Executive Reports)
• Starter: $20/month — 50,000 P-Tokens (10 Executive Reports)
• Pro: $30/month — 100,000 P-Tokens (20 Executive Reports)
• Executive: $50/month — 150,000 P-Tokens (30 Executive Reports)
• Agent: $100/month — 500,000 P-Tokens (100 Executive Reports)

5.3 Payment & Refunds

• All payments processed via Stripe (secure, PCI-DSS compliant)
• Prices displayed in USD; local currency conversion may apply
• Refund Policy: P-Tokens are non-refundable once a report is successfully generated
• If report generation fails due to our technical issue, P-Tokens will be refunded automatically
• Subscriptions can be cancelled anytime; unused P-Tokens will be forfeited upon cancellation
• 30-day money-back guarantee for first-time subscribers (email support@pushnask.com)

6. User Obligations & Prohibited Conduct

6.1 Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You will NOT:

• Upload false, misleading, or fraudulent information
• Attempt to reverse-engineer, decompile, or extract our algorithms
• Use automated tools (bots, scrapers) to access the Service
• Share your account credentials with others
• Resell or redistribute reports without written permission
• Use the Service to spam, harass, or violate others' rights
• Interfere with or disrupt the Service's infrastructure
• Attempt to gain unauthorized access to other users' accounts

6.2 Consequences of Violations

Violations may result in:

• Warning notification
• Temporary account suspension
• Permanent account termination without refund
• Legal action for severe violations

7. Intellectual Property Rights

7.1 Your Content

• You retain ownership of all data you upload (CV, profile information)
• You grant us a limited license to process your data for report generation
• Your raw data is deleted automatically after processing (see Privacy Policy)
• Generated reports are licensed to you for personal use only

7.2 Our Intellectual Property

• The PushNask platform, including design, code, algorithms, and branding, is our property
• The MCDA Engine methodology is proprietary and protected
• You may not copy, modify, or create derivative works without permission
• "PushNask" and our logo are trademarks (use prohibited without license)

8. Data Accuracy & Disclaimers

Use at Your Own Risk: You acknowledge that all decisions based on our reports are made at your sole discretion and risk.

9. Service Availability & Modifications

9.1 Uptime & Maintenance

• We strive for 99.5% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced 24 hours in advance
• Emergency maintenance may occur without notice

9.2 Changes to Service

• We may modify, suspend, or discontinue features at any time
• Major changes will be communicated via email (30 days notice)
• Continued use after changes constitutes acceptance

10. Termination

10.1 Your Right to Terminate

• You may delete your account anytime via Settings or by emailing support@pushnask.com
• Upon deletion, unused P-Tokens will be forfeited (subscriptions are non-refundable after 30 days)
• All data will be permanently deleted within 90 days

10.2 Our Right to Terminate

We may suspend or terminate your account immediately if:

• You violate these Terms
• Your account is involved in fraudulent activity
• You abuse or harass our staff or other users
• Required by law or court order

Termination for violations results in forfeiture of unused P-Tokens and immediate account suspension (no refund).

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PushNask is provided "AS IS" without warranties of any kind
• We are not liable for decisions made based on our reports
• Our total liability is limited to the amount you paid in the last 12 months (maximum $500 USD)
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for third-party data source errors

12. Indemnification

You agree to indemnify and hold PushNask harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your use or misuse of the Service
• Your violation of any third-party rights
• Any content you upload or submit

13. Governing Law & Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

13.2 Dispute Resolution

Before initiating legal action, you agree to:

• Step 1: Contact support@pushnask.com with your complaint
• Step 2: Attempt good-faith negotiation for 30 days

We may update these Terms to reflect:

• Changes to our services
• Legal or regulatory requirements
• Security or operational improvements

Notification: Material changes will be emailed 30 days before the effective date. Continued use after changes constitutes acceptance.
